美國總統歐巴馬已否決2013年6月美國國際貿易委員會(以下簡稱『ITC』)針對蘋果公司部分產品發布的進口禁令。
根據中經網報導，ITC的這一禁令針對AT&T版iPhone 4和iPhone 3GS，以及3G版iPad和iPad 2。該部門此前裁定，蘋果公司的這些產品侵犯了三星一項美國專利號為7706348的專利。這項專利題為『CDMA移動通信系統中對格式合並指示符傳輸進行編解碼的裝置和方法』。
美國貿易代表邁克爾·弗羅曼(Michael Froman)在致ITC主席埃文·威廉姆森(Erving Wlliamson)的一封郵件中表示:『在諮詢貿易政策參謀委員會和貿易政策評估小組之後，我決定不批准ITC的這一決定，即在這項調查中發出驅逐令和禁止令。』
這封郵件中還表示，歐巴馬政府致力於推動創新和經濟發展，包括為知識產權權益提供適當而有效的保護措施。
美國科技博客The Verge表示，這是自1987年美國前總統雷根以來，美國歷任總統首次駁回ITC的判決。美國聯邦貿易委員會(以下簡稱『FTC』)近期曾對各大公司將銷售禁令作為一種競爭手段的做法表示批評。FTC認為，這樣的做法將影響競爭對手產品和公司，無法帶來有競爭力的貿易環境。美國科技資訊網站CNET此前援引業內專家的說法稱，美國政府不太可能干涉ITC的判決。
上周，Verizon律師蘭達爾·米爾奇(Randal Milch)發出一封公開信，要求歐巴馬對本案做出干涉，駁回禁令。如果歐巴馬不進行干涉，那麼禁令將於8月5日生效。
